On May 6, 2021, Deputies were alerted to a chase involving a stolen Cocoa Police Department vehicle heading north on I-95, entering Volusia County in Oak Hill. Deputies arrived in the area and set up stop sticks along I-95.

At mile marker 249 N I-95, VSO Deputy M Webb successfully deployed stop sticks on the car. At mile marker 252 N I-95, a Cocoa police officer successfully performed a PIT maneuver on the car, resulting in the stolen vehicle coming to rest in the wood line.

Sergeant C Geiger of the Edgewater Police Department then pinned the vehicle with his patrol car to prevent the suspect from fleeing. VSO deputies and police officers surrounded the car and ordered the lone passenger, later identified as Xavier Cummings, to exit the stolen police vehicle.

Cummings then exited the driver's side door, armed with a large crowd dispersing pepper spray canister and sprayed multiple Deupties. Cummings dashed straight for a Cocoa Police K-9 truck, which was parked on I-95 at the time and had the keys in the ignition, unlocked. The K-9 unit was not in the car at the time the second police cruiser was stolen.

Cummings entered the Cocoa Police K-9 vehicle through the driver's door and sat in the driver's seat, still armed with pepper spray. A Cocoa cop used his Taser on Cummings and hit him in the left side of his chest with one probe, which was unsuccessful. Cummings was then able to get away and flee north on I-95 at a high rate of speed.

The car was pursued north on I-95 by deputies and police. At mile marker 256 N I-95, VSO Sergeant J Hattaway and Port Orange police officers successfully placed stop sticks on the car, causing three of the tires to deflate. Sustaining significant damage to multiple tires, the vehicle slowed and came to a stop in the median at mile marker 258 N I-95, Daytona Beach. Cummings surrendered after the second police cruiser had been disabled and was then taken into custody without incident by deputies and police officers.

Cummings was charged with armed burglary of a conveyance, escape, fleeing or attempting to elude law enforcement, possession of a firearm by a convicted felon (2 counts), grand theft firearm (2 counts), grand theft motor vehicle (2 counts), and driving while license suspended (habitual).
