This agency-provided footage shows a police officer in Rochester, New York responding to a call for service, wherein a suspect- Todd Novick, 46- flees the scene and draws what appears to be a handgun during the ensuing chase. The officer shoots and handcuffs the fleeing suspect while his partner calls for medical support. Despite the quick call for medical, Novick died as a result of his injuries. The suspect’s weapon was later found to be a Crossman C11 BB pistol. Drawing a C02-powered facsimile of a pistol on two cops with two real weapons is a bold strategy, but this video demonstrates how quickly the officers had to register the object as a weapon and react. It then breaks down the shoot, almost frame-by frame, showing the suspect drawing the weapon and looking back at the officers, establishing intent. Rochester Police Chief David Smith is quoted as saying “When you’re running with a gun in your hand, I submit you are not fleeing. You are trying to obtain a better tactical position.” He maintains that “fleeing” would have included dropping the gun beforehand – although drawing it at all would likely have yielded the same result- or leaving it pocketed.
